9.b.3. Renew Loss Control Services Agreement – Keenan & Associates
Recommended Motion:
Renew Loss Control Services Agreement between Keenan & Associates and Alvord Unified School District, effective July 1, 2022 through June 30, 2023.  This expenditure will be included in the 2022-2023 budget.
Rationale:

Annual renewal of the Loss Control Services Agreement, currently in place through Keenan & Associates, provides for the continued compliance for the district’s Hazardous Communications compliance program. All hazardous materials are inventoried by a Hazardous Material Inventory (HMI) Specialist. Upon completion of the inventory an online Safety Data Sheet management tool is updated to indicate the location of each chemical inventoried for compliance. The goal of the loss control services is to promote safety awareness, assist in the identification of conditions which may pose risk of injury to students and/or staff, and provide recommendations and/or suggestions to help mitigate the risks identified.

Staff recommends to approve renewal of the Loss Control Services Agreement with Keenan & Associates.

9.b.4. Approve Agreement – Cooperative Strategies, LLC
Recommended Motion:
Approve agreement between Cooperative Strategies, LLC and Alvord Unified School District for professional consulting services including residential development school fee justification studies, effective May 20, 2022 through December 30, 2022. 
Rationale:

Cooperative Strategies, LLC shall prepare: Residential and Commercial/Industrial Development School Fee Justification Studies for Alvord Unified School District. The Studies will justify statutory school fees for the School District and will also identify the full school facilities impacts to be mitigated by these types of development within the School District.  

The scope of professional services provided includes the following activities and tasks: student generation factors, existing school facilities capacity, future residential units, existing capacity vs. student enrollment, student enrollment projections, school facility needs, school facility costs, school facility impact for analysis for residential development, study preparation, employer research, commercial/industrial fee analysis, school facilities impact analysis for commercial/industrial development, study preparation, and respond to public comments.

Board approval will allow Cooperative Strategies to proceed with professional services and studies.

Recommended Motion:
Approve agreement between John R. Byerly, Inc. and Alvord Unified School District to perform geotechnical (soils) engineering services and laboratory testing at Collett Elementary School, effective May 20, 2022 through December 31, 2022. 
Rationale:
Geotechnical and laboratory testing is required for the parking lot project at Collett Elementary School. The work will be performed after the school year ends.  John R. Byerly, Inc. has provided these services in the past and has proven to be a reliable vendor. 

Board approval of this item will allow John R. Byerly, Inc. to proceed with services.

Recommended Motion:
Approve agreement between New Dimension General Construction, Inc. and Alvord Unified School District for the Keller Site Modifications – Building B Project, effective May 20, 2022 through September 30, 2022, under District CUPCCAA procedures as outlined below. 
Rationale:

On December 12, 2019, the District adopted Resolution No. 32 BA and 33 BA electing to participate in the California Uniform Public Construction Cost Accounting Act (“CUPCCAA”). CUPCCAA requires specific procedures to remain compliant, inclusive of bidding maintenance and public projects undertaken for projects with a value of $60,000 or more. 

As a CUPCCAA District, projects under $60,000 only require informal written proposals in accordance with District policy and internal procedures. District staff must still follow all other requirements related to the Department of Industrial Relations (“DIR”) prevailing wage, insurance, plus payment and performance bonds when the value of the contract exceeds $25,000.

The District has ongoing requirements for variety small maintenance and public projects under $60,000 in order to maintain or improve facilities. Staff notified nine (9) qualified contractors from its approved CUPCCAA list and obtained two (2) written proposals for the project and has determined that the fee is competitive and includes required services.

This contract is effective for July 1, 2022 through June 30, 2023 and will be included in the 2022-2023 budget.

Rationale:
Fleet Crew Maintenance Solutions provides annual cleaning services to the diesel particulate filter de-ash system required by the State of California, as needed for Child Nutrition Services.

Recommended Motion:
Approve contract between Arrow Restaurant Equipment and Alvord Unified School District for the installation of kitchen equipment at various Child Nutrition Services sites, effective July 1, 2022 through June 30, 2023. This expenditure will be included in the 2022-2023 budget.
Rationale:
Arrow Restaurant Equipment provides delivery and installation of kitchen equipment to various sites.  Standard installation will be based on utility connections within areas of installation.  All areas and entrances must be accessible.  Delivery and installation to Child Nutrition Services sites are to be completed during normal business hours, Monday through Friday.

Board approval will allow Arrow Restaurant Equipment to proceed with services starting July 1, 2022.

Rationale:

Alvord Unified School District operates a Self-Insured Workers’ Compensation program for claims filed prior to July 1, 2016, and is required to obtain an actuarial study every three years.  The actuarial study determines the ultimate exposure of the district’s workers’ compensation liabilities as of June 30 for the year of the report. Alvord is converting from an every year cycle to an every other year cycle starting 6/30/2022.

9.d.1. Ratify Agreement – Castle Park, Valley View Elementary
Recommended Motion:
Board approval is requested for the ratification of the agreement between Castle Park and Alvord Unified School District for Valley View fifth grade students to attend an end-of-the year fifth grade field trip. The effective date of this agreement would be May 12, 2022.

Rationale:
Board approval of this agreement will allow Valley View Elementary School to send fifth grade students that are meeting promotion requirements to attend Castle Park in Riverside, California on Thursday, May 12, 2022. 

This agreement is being brought as a ratification due to this field trip being recently approved to be funded by PTA. In working with Castle Park, the only date available for a school activity trip was in early May, which didn’t allow for adequate time to request board approval.

Recommended Motion:
Board approval is requested to amend the agreement with Trilogy Medwaste for pick up and disposal of medical waste. 
Rationale:

The Trilogy Medwaste agreement was approved at the April 21, 2022 board meeting, Item 10.3.13. for a 60-month as needed pick-up of medical waste at $100.00 per pick up. Health services anticipates needing two pick up's per school year and therefore the total fiscal impact has increased over the 60 month agreement. 

Board amendment will allow Trilogy Medwaste to dispose of items identified as medical waste and dispose of them in accordance with state and federal regulations.

9.d.3. Amend Memorandum of Understanding – WestEd
Recommended Motion:
Board approval is requested for an amendment to the Memorandum of Understanding between WestEd and Alvord Unified School District to provide the California School Climate, Health, and Learning Survey (CalSCHLS) to students in grades 5th, 7th, 9th, 11th, parents, and staff in order to meet the State requirement of including survey results in the LCAP.  This MOU will be effective September 1, 2021 through August 31, 2022.

Rationale:
The CalSCHLS system was created by the California Department of Education (CDE) to efficiently and cost-effectively provide school districts and their partner communities with quality local data which can be used to improve student academic performance including social-emotional, behavioral, and physical health of all youth.  It assesses key indicators linked to success in school, career, and life. 

The Board approved this agreement on November 4, 2022 under Item 10.d.5. for a fiscal impact of not-to-exceed $8,000.00.  Due to an additional 1,071 students taking this survey the amount increased to $8,071.20.

Board approval of this MOU will allow the district to conduct the CalSCHLS to gather evidence of school connectedness and the social-emotional well-being of students.  The results will serve as a reflective tool to identify and plan for supports to meet the needs of our students.

9.d.11. Approve Professional Services Agreement– Hollar Speech and Language Services
Recommended Motion:
Board approval is requested for a multi-year, professional services agreement between Hollar Speech and Language Services and Alvord Unified School District to provide a Speech and Language Independent Educational Evaluation (IEE).  The IEE includes comprehensive testing, observation, report to parent and district, and participation in the IEP meeting to discuss the evaluation results.  This agreement will be from May 20, 2022 through June 30, 2023.
Rationale:
The Alvord Special Education Department receives requests from parents of students with disabilities for Independent Educational Evaluations.  These requests are made in accordance with California Educational Code 56329(b) A parent or guardian has the right to obtain, at public expense, an independent educational assessment of the pupil from qualified specialists, as defined by regulations of the board, if the parent or guardian disagrees with an assessment obtained by the public education agency, in accordance with Section 300.502 of Title 34 of the Code of Federal Regulations.  The District must choose between defending their assessment by filing for Due Process or granting the request. This provider has been requested by parents as part of the IEP process.  The provider meets the professional qualifications required and is within the fee range of other similar providers.  

Board approval of this item will allow Hollar Speech and Language Services to provide an Independent Educational Evaluation for a special needs students based on a parent request.  Hollar Speech and Language will begin the assessment during the end of the 2021-2022 school year.  They will complete the assessment, report and attend the IEP during the 2022-2023 school year.  Billing will occur once the IEP is held.  At this time, there will be no fiscal impact for the 2021-2022 school year.

The effective date of this agreement is June 1, 2022 – August 31, 2022.

Rationale:

Achieve 3000 shall provide software licenses to support student intervention aimed at increasing DLI student Spanish language and literacy proficiency. The program will deliver access to non-fiction, engaging text that is aligned to grade level Spanish language arts, science, and history-social science standards. Additionally, teachers will receive access to online resources that will enable them to integrate the non-fiction text into their instructional planning.

Under this agreement, Achieve 3000 shall provide student site licenses to DLI students in the summer academy. In addition, teachers of the DLI summer academy shall receive two web-based professional learning sessions.

Board approval of this agreement will make it possible for Achieve 3000 to provide software licenses to DLI students in the summer academy.

Recommended Motion:
Board approval is requested for the renewal of the Member Subscription Agreement for the eTranscript platform from Parchment LLC for the 2022-2023 school year, effective July 1, 2022 to June 30, 2023.  The eTranscript platform offers a secure online ordering and tracking system of electronic transcripts for all Alvord Unified School District high schools.
Rationale:

Parchment's eTranscript platform enables the secure, rapid exchange of millions of electronic transcripts among more than 10,000 schools and universities and thirteen state education agencies.  The program is a single source for students, alumni, and school staff to order, approve, and track transcript orders to colleges, universities, and other destinations.  Alvord Unified School District entered into an agreement with Parchment on June 14, 2016 for services.  This Amendment #6 would renew the subscription for the 2022-2023 term.

The annual subscription covers the request of unlimited transcripts for up to 6,000 students and/or alumni.  Electronic delivery of transcripts is included in each request.

Approval of this agreement would allow Alvord Unified School District high schools to continue using this program for a more convenient, secure,  and efficient method of tracking transcript requests.

This agreement will cover the gap month. Ellevation is offering this renewal gap to be filled with a complimentary/free month of Strategies subscription for ease.

Recommended Motion:
Board approval is requested for an agreement between California Baptist University and Alvord Unified School District for an end-of-the year swim day for fifth graders from Terrace Elementary. The effective date of this agreement is May 25, 2022.
Rationale:
5th grade students will visit the California Baptist University campus in support of our college and career readiness culture. Students will have an opportunity to go to the Aquatic Center. The day will begin with a lesson on swim safety by CBU lifeguards, followed by a short campus tour.

Rationale:
McAuliffe Elementary has been working with Castle Park to provide students with a field trip that incorporates the 5th grade math standards to everyday life and activities. Fifth grade students will take a trip to Castle Park on the day of the event. Admission to Castle Park and a meal ticket for each student would be provided under this agreement. It is estimated that one hundred eight students and seven chaperones will attend this event.

Board approval of this agreement will make it possible for 5th grade students at McAuliffe Elementary to attend the Castle Park event.

Rationale:
The District Leadership Academy would like to hold their last meeting of the 2021-2022 school year at the Nixon Presidential Library and Museum for their end of the year culminating activity.  Under this agreement, the National Archives and Records Administration would provide access to the library for a one-day event on May 31, 2022.  

Board approval of this agreement would allow the District to proceed with the application process for the use of space at the Nixon Presidential Library grounds on May 31, 2022.

Rationale:
Renaissance provides Alvord Unified School District with an Annual Renaissance Data Integrator (RDI) service in which student data from the previous school year is rolled over and integrated to the new year.  This data integration is completed for Accelerated Reader, a web-based application used as a motivational reading practice program.

Schools use site funding to purchase Accelerated Reader (AR) licenses.  The maintenance fee will support AR for elementary students.  

Board approval will allow the District to continue to utilize these data integration and maintenance services from Renaissance for elementary schools using Accelerated Reader for the 2022-2023 school year.

The ENVOLVE program was founded to help school campuses everywhere improve student activity participation and school culture. “Student activities exist to create phenomenal communities within schools. The more students participate in activities, the more at home they feel. The more at home they feel, the more successful they will become in school and life.”  

Scott Backovich Communications provides ENVOLVE training which offers the most current and relevant leadership practices to help students and advisors create more engaging student activities.  Teachers have access to curriculum and activities to recharge the culture and communities of high school campuses post-COVID.  The training would be offered to District Activity Directors.

Board approval of this agreement would allow Scott Backovich Communications to provide ENVOLVE training to district activity directors during the 2022-2023 school year.

Rationale:
Top Youth Speakers facilitates speaking engagements for Dr. Laymon Hicks - a motivational speaker that empowers students to overcome barriers.  Dr. Hick’s leads students through the most powerful life principles they need to pursue their dreams and goals so that they can achieve greatness.  As he shares his own unique story, he is able to connect with them to show them how to spin their world around and change their lives for the better.

Hillcrest High School would like to host Dr. Laymon Hicks to speak to the entire student body at assemblies scheduled at the beginning of the 2022-2023 school year. 

Under this agreement, Dr. Hicks would provide two (2) 45-50 minute motivating, engaging keynote presentations to students to help build culture and spirit on campus.

Board approval is requested for fifteen students and two chaperones from La Sierra High School to attend the Girls Volleyball Sweetwater Tournament on September 2-3, 2022, at Sweetwater High School in San Diego, California.
Rationale:
Members of the La Sierra High School’s Girls’ Varsity Volleyball team will have the opportunity to participate in a competitive volleyball tournament against teams that they normally do not get a chance to play against in the regular season.  This trip will give the students an opportunity to bond and gain the experience of traveling overnight with teammates for a tournament.  
 
Students and chaperones will travel from Riverside to San Diego in district vans.  Accommodations will be arranged at a hotel near the venue.  All female student athletes will be chaperoned by female chaperones.  The number of chaperones is in line with Board Policy 6153, School-Sponsored Trips, of one adult per seventeen students for overnight trips.  

Board approval of this overnight trip will allow fifteen students and two chaperones from La Sierra High School to attend the Girls Volleyball Sweetwater Tournament September 2-3, 2022, at Sweetwater High School in San Diego, California.

(Kids in Need of Doctors) program.  Project K.I.N.D. will provide access to health care providers and health services to children attending schools in the Alvord Unified School District, for the 2021-2022 school year.
Rationale:
Project K.I.N.D. is a community based collaborative group, built around a coalition of professional health care providers.  For the past fourteen years, Health Services has received health care, eye glasses, vision and dental services for low income students in the Alvord Unified School District.

Board approval will allow the District to continue to coordinate with Project K.I.N.D. to provide access to medical, dental, vision, and prescription services for low income students attending schools within the Alvord Unified School District.

Board approval is requested for a memorandum of understanding between the California Air Resources Board (CARB) and Alvord Unified School District to establish a partnership to promote clean air and climate change awareness to district students and staff.  The effective date would be May 20, 2022 through May 20, 2027.
Rationale:
The California Air Resources Board is the agency responsible for providing healthful air to Californians.  It is a leader in programs that reduce emissions of greenhouse gasses.  Recently, the agency opened up their new headquarters in Riverside, California and has made a commitment to work with local educational institutions such as UCR, RCCD, RCOE, California Baptist University, and La Sierra University, to name a few, in developing an educational pathway from K-12 through university level to provide educational opportunities relating to air quality and climate change.  

The success of their program depends on partnerships to build a strong and diverse workforce to tackle the air quality and climate change challenges particular to the Inland Empire.

Board approval of this memorandum of understanding will confirm the District’s commitment to work in partnership with the California Air Resources Board to achieve the purposes of the MOU.

Rationale:

Effective June 15, 2018, the District entered into an Employment Agreement with the Superintendent. Under the Employment Agreement, the Superintendent was employed through June 15, 2022. On June 3, 2021, the Board approved a First Amendment to the Superintendent's Employment Agreement where it extended the Superintendent's contract for one year, setting the termination date at June 30, 2023. The First Amendment also increased the Superintendent's salary for the 2021-2022 and 2022-2023 school years. All other terms of the Employment Agreement remained unchanged.

The Board now seeks to enter into the Second Amendment to the Superintendent's Employment agreement for the purposes of providing the Superintendent with an addition 4 year term to begin on July 1, 2022 and continue through June 30, 2026. The Superintendent's salary for the 2022-2023 school year will be $307,550 and will increase by 3% each year thereafter. As provided in his original contract, the Superintendent will render 224 days of service to the District. The Superintendent's non-work days consist of all Board approved holidays and 22 additional non-work days. The Superintendent may accrue up to 22 non-work days and if he exceeds this maximum, he may elect to be paid for up to ten of the accrued non-work days. The Superintendent will also receive medical, dental, and vision benefits, a life insurance policy, a cellular telephone, and a computer at no cost to the Superintendent. The District will also provide for the Superintendent's membership in two professional organizations.

FISCAL IMPACT: For the 2022/23 school year, $307,550. For each subsequent year, an additional 3% pursuant to the salary schedule.

Using Pajaro Unified School District piggyback/cooperative agreement to obtain the modular classrooms from Mobile Modular Management, the District is able to save time and money through utilizing the piggyback. At the close of each fiscal year, a resolution for authorization of year-end budget revisions is submitted for Board approval.

Education Code Sections 42601 and 42602 permit the Governing Board to adopt a resolution authorizing the County Superintendent of Schools (RCOE) to make budget transfers and revisions necessary to complete the fiscal year-end closing process. 

To ensure the integrity of the board approved operating budget, year-end budget transfers and revisions are limited to major object classifications between Reserve Accounts and the appropriate revenue and expenditure account classifications. The District will prepare and direct RCOE to approve the appropriate transfers needed for the year-end fiscal closing. All transactions that fall within this Board Resolution will be reflected in the 2021-22 Unaudited Actuals Financial Report, which will be presented to the Board in September, 2022.

10.f.2. Consideration and Action of Employment Contract with Chief Business Officer
Recommended Motion:
Board approval is requested for consideration and action on employment contract with Chief Business Officer.
Rationale:
Effective July 1, 2022, the District and the Chief Business Officer will enter into an employment agreement. The District seeks to offer the employment contract of the Chief Business Officer for the term of three years. Under the proposed employment agreement, the Chief Business Officer will be employed from July 1, 2022 through June 30, 2025. The agreement will also provide for the Chief Business Officer’s membership in two professional organizations. The District will also provide the Chief Business Officer with health and welfare benefits and a life insurance policy. The Chief Business Officer shall be required to provide 221 days of service to the District.

FISCAL IMPACT: None (This position is already in the 2022-23 budget)

Recommended Motion:
Board approval is requested for consideration and action on employment contract with Assistant Superintendent, Human Resources.
Rationale:

10.f.4. Approve Addition of Fourteen Instructional Assistant Positions – One Per Elementary Site
Recommended Motion:
Board approval is requested for the addition of fourteen 7.0-hour, 10.0-month Instructional Assistant positions for the elementary sites.
Rationale:
The District will be implementing an all-day Transitional Kindergarten and Kindergarten program for the upcoming 2022-23 school year.  In an effort to provide additional support, the District will be providing one Instructional Assistant per elementary site for the 2022-23 school year.
 
FISCAL IMPACT:  $753,180.00 (General Fund/Restricted - ELO)
 
10.f.5. Approve Addition of Three Physical Education Assistants – Educational Services Division
Recommended Motion:
Board approval is requested for the addition of three 6.0-hour, 10-month Elementary Physical Education Assistant positions for the Educational Services Division.
Rationale:
Assembly Bill 1973 requires the implementation of full day Kindergarten at all of the district elementary schools for the 2022-23 school year.  Both full day TK and Kindergarten students will participate in physical education now that the instructional day will be extended for these students.  This situation creates the need for three additional elementary physical education assistants to cover all fourteen district elementary schools.

The District is requesting three additional Physical Education Assistant positions at this time. This will allow our department to adequately provide the necessary support for the additional TK and Kindergarten physical education classes.  

FISCAL IMPACT:  $152,187.00 (General Fund/Restricted- LCAP)
 
10.f.6. Approve Addition of One 8.0-Hour, 10.5-Month Occupational Therapist Assistant Position – Special Education Department
Recommended Motion:
Board approval is requested for the addition of one 8.0-hour, 10.5-month Occupational Therapist Assistant position for the Special Education Department.
Rationale:
The Special Education Department is currently staffed with four Occupational Therapists and one Occupational Therapist Assistant.  The District is currently contracting out for additional support. This option is no longer cost effective for the District.

The addition of one Occupational Therapist Assistant will allow the district to meet the needs of Special Education students as well as eliminate the need to contract out for services.

FISCAL IMPACT: $91,332.00 (General Fund/Restricted – Special Education)

Board approval is requested for the addition of three Full-Time, 185-Day Elementary Physical Education Teacher positions for the Educational Services Division.

Recommended Motion:
Board approval is requested for the addition of one 8.0-hour, 215 -Day Director II - Expanded Learning (TK-5) Opportunities Program position for the Educational Services Division.
Rationale:
The District does not currently have the position of Director II - Expanded Learning (TK-5) Opportunities Program (ELO-P). The District would like to eliminate the Director I, Expanded Learning effective July 1, 2022, and promote the current director to the new position of Director II. Administration recognizes the necessity for an experienced school administrator to plan, develop, and implement the elementary level Expanded Learning Opportunities Program (ELO-P) grant program as well as continue the work currently being done in the After School Education and Safety Program (ASES) program. The savings from the elimination of the Director I will offset the fiscal impact of adding the Director II, ELO-P (TK-5) position.  

FISCAL IMPACT:  $13,771.00 (General Fund/Restricted – Expanded Learning Opportunities Program/ASES)

Recommended Motion:
Board approval is requested for the addition of one 8.0-hour, 215 -Day Director II - Expanded Learning (6-12) Opportunities Program position for the Educational Services Division.
Rationale:
The district does not currently have the position of Director II - Expanded Learning (6-12) Opportunities Program. Administration recognizes the necessity for an experienced school administrator to plan, develop, and implement the secondary level Expanded Learning Opportunities Program (ELO-P) grant program and athletics. 

FISCAL IMPACT:  $214,292.00 (General Fund/Restricted – Expanded Learning  Opportunities Program)
 
10.f.10. Adopt Resolution No. 55 – Elimination of 1.0 Certificated Management Position – Director I, Expanded Learning
Recommended Motion:
Board approval is requested for adoption of Resolution No. 55 – Elimination of One Certificated Management Position.
Rationale:
The Alvord Unified School District hereby recommends that the following certificated management position – Director I, Expanded Learning, be eliminated effective July 1, 2022.  The current certificated employee will be promoted to the Director II – Expanded Learning (TK – 5) Opportunities Program position.
 
The savings from the elimination of this position will be used to add a Director II – Expanded Learning (TK – 5) Opportunities Program position.

Recommended Motion:
Board approval is requested for adoption of Resolution No. 56 - Release of Temporary Employees.  California Education Code Section 44954(b) allows the Governing Board of a school district to release temporary employees.
Rationale:
California Education Code Section 44954 (b) states that the Board may release a temporary certificated employee if the employee is notified before the end of the school year of the District’s decision not to reelect the employee for the next succeeding school year.  

Each year, the District hires temporary employees to backfill certain certificated employees who are on leave to serve in those positions and to backfill employees on leave for illness. Using temporary employees in these cases, allows the District to have flexibility in staffing and also serves as a preventive measure to overstaffing.
