As authorized by Governor Newsom’s Executive Order N-29-20, dated March 17, 2020, the Alvord Unified School District will conduct all meetings of the Governing Board via teleconference until further notice. The meetings will be live streamed via YouTube: Click Here

Pursuant to Executive Order N-29-20, the Governing Board will take public comment. All public comments must be submitted in writing in advance of the meeting. Please submit your written public comments to: 2Superintendent@alvordschools.org no later than 9:00 a.m. on September 10, 2020.

During the Governing Board meeting, written public comments received in a timely manner will be read for the Governing Board.  Pursuant to Board Bylaw 9323, public comment period will be limited to twenty (20) minutes.  Duplicative public comments will not be read during the meeting.  However, all written public comments will be provided to the Governing Board in advance of the meeting.

8.b. Administrative Services
8.b.1. Ratify Agreement – Koury Engineering and Testing, Inc. – Various Sites
Recommended Motion:
Ratify agreement between Koury Engineering and Testing, Inc. and Alvord Unified School District, to provide testing and inspections as needed at Villegas Middle School solar project, La Sierra and Norte Vista high school gym HVAC projects, effective August 15, 2020 through October 30, 2020.  This expenditure is included in the 2020-2021 budget. 
Rationale:
On June 25, 2020 the Board approved an agreement with Koury Engineering to provide geotechnical engineering, material testing, and inspection services for the solar project at Villegas Middle School.  This amendment will allow Koury Engineering to also provide services for the La Sierra and Norte Vista high school gym HVAC projects and increase the agreement by $10,000.00.

Contract Template II Agreement will be used for this contract, which was Board Approved on August 20, 2020.  

FISCAL IMPACT:  Increase $10,000.00 (General Fund/Restricted-Maintenance)
 
8.b.2. Approve Amendment No. 1 – First Student, Inc. – District-Wide Transportation
Recommended Motion:
Approve amendment no. 1 between First Student, Inc. and Alvord Unified School District for student transportation services, effective August 10, 2020 through December 31, 2021.
Rationale:
On June 25, 2020 the Board of Education approved item 8.b.3, but due to COVID-19 an amendment is necessary. This amendment acknowledges that one of the presumed goals underlying Section 18006 of the CARES Act is that payments to contractors made in accordance with Section 18006 (“each CARES Act Payment”) will allow service providers to continue to pay their employees, so that the employees will have financial resources available during the period schools are closed, thereby enabling the services providers to be able to resume providing necessary services when the current COVID-19 public health emergency ends. This amendment also acknowledges that regardless of whether any governmental entity subsequently issues mandatory provisions or guidance regarding those matters, the District and First Student have entered into this Amendment No. 1 to, among other things, implement, on a good faith basis, the provisions of Section 18006 of the CARES Act as those relate to periods when School Closures occur during the Regular 20-21 School Year (“School Closure Periods”).
First Student, Inc. acknowledges that a primary intent and goal of the District, in entering into this Amendment No. 1, is to achieve continuity with respect to Transportation Services to be provided during the School Open Periods; specifically, that: (i) subject to limitations set forth in this Amendment No. 1, the contractor shall be ready, willing and able to provide any and all Transportation Services, as requested by the District, to be provided during the School Open Periods; and (ii) the same drivers who were providing Transportation Services for or on behalf of the District prior to when the School Closures commenced shall also provide those services for or on behalf of the District during the School Open Periods. In addition, the Parties acknowledge and agree that the District’s obligations to make payments to the Contractor pursuant to this Amendment No. 1 shall: (i) apply only to School Closure Periods; (ii) be and remain in effect only during the District’s regular 2020-2021 school year (i.e., not including any extended school year, summer school, or similar programs) that ends on or around May 28, 2021 (“Regular 2021 School Year”); and (iii) be and remain in effect only if and to the extent the District has ESSER Funds available, as described herein, to make such payments to the Contractor. 

FISCAL IMPACT:  Reduction of 50% ($175,000.00 per month – General Fund/Restricted-CARES Funding)

8.b.3. Amend Contract – Gilmore’s Backflow Testing and Services – District-Wide
Recommended Motion:
Amend contract between Gilmore’s Backflow Testing and Services and Alvord Unified School District, to perform backflow testing and repairs throughout the District, effective September 10, 2020 through June 30, 2021. This expenditure is included in the 2020-2021 budget.
Rationale:
In July 2020, Gilmore’s Backflow Testing and Services performed annual inspections on all District backflows and during inspections they determined that there are necessary repairs that are needed in order to remain in compliance. This amendment will allow Gilmore’s Backflow Testing and Services to proceed with repairs, retest and resubmit reports to City of Riverside. This amendment will allow Gilmore’s Backflow Testing and Services to proceed with needed services.

Contract Template III Agreement will be used, which was Board Approved on August 20, 2020.

8.b.4. Award Contract – FC & Sons Roofing, Inc. – District-Wide
Recommended Motion:
Award contract between FC & Sons Roofing, Inc. and Alvord Unified School District to provide roof inspections district-wide, effective September 11, 2020 through June 30, 2021. This expenditure is included in the 2020-2021 budget.
Rationale:
Annual roof inspections will be conducted as required by our insurance provider.  This will ensure that all District-owned property are in good working order.  FC & Sons Roofing, Inc. will make the necessary recommendations for repairs as well as provide photos of their findings.  This will enable the district to make the necessary repairs and to stay on top of any issues.  This agreement will be for the 2020-2021 school year.

Board approval of this item will allow FC & Sons Roofing, Inc. to provide these services.

8.c.2. Approve Associated Student Body (ASB) Fundraisers for 2020-2021
Recommended Motion:
Board approval is requested for Associated Student Body (ASB) fundraisers for the 2020-2021 school year.  Approval of the ASB fundraisers will allow all school sites to move forward with ASB activities for the current school year.
Rationale:
The objective of ASB is for all students to enjoy extra-curricular activities, such as sports, dances, rallies, and club, team & school activities. These events unify the students at each school site, raise school spirit, and present students with opportunities to learn the principles of operating small businesses and acquire leadership skills.  Students learn how making a contribution to their school and fellow students can improve their own educational experience. As students and staff work together to plan projects and activities, students also learn project planning.

Our ASB Fundraisers list has a new look and is being brought on behalf of all schools sites. The fundraiser list will be revised as new ideas are received from school sites & students.

8.d.1. Ratify Contract - McGraw-Hill Education
Recommended Motion:
Board approval is requested for the ratification of the contract with McGraw-Hill Education for the purchase of Study Sync English Language Arts student licenses for 6th through 12th grades as well as accompanying teacher resources during the 2020-2021 school year.
Rationale:
The contract will include 3020 student licenses for distance learning as well as the student workbooks and free teacher resources. This is a current adoption for 6th – 8th grades which we are expanding to 9th – 12th grades.

Ratification of this contract with McGraw-Hill Education will provide access to distance learning student licenses to McGraw-Hill Study Synch resources for students in grades 6th through 12th.

8.d.2. Ratify Client Services Agreement–Sunbelt Staffing, LLC
Recommended Motion:
Board ratification is requested for a short-term client services agreement between Sunbelt Staffing, LLC and Alvord Unified School District from September 10, 2020 through December 31, 2020.  This agreement allows Sunbelt to recruit and provide contract speech/language pathologist assistants to provide therapy services for special needs students as required by their Individualized Education Program (IEP).
Rationale:
The Special Education department requires Speech Language Pathology Assistants (SLPA) to provide therapy sessions and prepare therapy materials while the licensed speech pathologist completes 2019-2020 delayed and upcoming assessments, writes reports, attend IEP meetings, and continue to provide therapy. 

The cost of this agreement will be funded through CARES.  This will result in a reduction in the amount of the original agreement with Sunbelt which is funded with Special Education AB602 funds.

Board approval is requested to approve the short-term client services agreement with Sunbelt Staffing, LLC from September 10, 2020 through December 31, 2020.  This agreement allows Sunbelt to recruit and provide contract Speech/Language Pathologist Assistants to provide therapy services for special needs students as required by their Individualized Education Program (IEP).

8.d.3. Ratify Maintenance Service Agreement – Konica Minolta Business Solutions U.S.A., Inc. – District Owned Copier at Stokoe for Special Education Pre-School Assessment Team
Recommended Motion:
Ratify maintenance service agreement between Konica Minolta Business Solutions U.S.A., Inc. and Alvord Unified School District for the maintenance, service and repair of a District-owned copier at Stokoe Elementary for the Special Education Pre-School Team, effective July 1, 2020 through June 30, 2021.  This is year 4 of a 5-year agreement.
Rationale:

Konica Minolta provides maintenance copier service, usage, supplies (toner and staples) and replacement parts to all of our sites. Konica Minolta has been a valued business partner with Alvord Unified School District for over 16 years.  They are in the industry for imaging equipment and the district has been pleased with the service they have provided. 

Board ratification of the Annual Maintenance Contract with Konica Minolta will allow them to continue providing maintenance on the copy machine at Stokoe Elementary School for the Special Education Pre-School Assessment Team. 

FISCAL IMPACT: Not to exceed $400.00 (General Fund/Unrestricted)

8.d.4. Amend Teletherapy Professional Development and Platform License Agreement– PresenceLearning, Inc.
Recommended Motion:
Board amendment is requested for the Teletherapy Professional Development and Platform License Agreement between PresenceLearning, Inc. and Alvord Unified School District to increase the number of service provider licenses.  This agreement provides for a HIPPA approved therapy and assessment platform, training and technical support for Alvord Related Service Providers during the 2020-2021 school year.
Rationale:
The Special Education Team determined there was a need for a HIPPA approved platform to provide virtual services and instruction to students with special needs.  The Team met with different vendors to review their platform for ease of use, HIPPA compliance, and the number and types of virtual assessments available.

Additional licenses are needed for one additional speech/language pathologist, four speech/language pathologist assistants (SLPA), and a certified occupational therapist assistant (COTA), in order for them to provide services to students while under supervision of a licensed speech pathologist or occupational therapist.

PresenceLearning has been providing teletherapy through contracted service providers for several years.  With the onset of the COVID-19 school closures and virtual instruction, PresenceLearning opened their platform, via licensing, to districts to assist with providing virtual therapy to students with special needs. Their program is the best fit for Alvord staff and students.

Board amendment of this item will allow PresenceLearning, Inc. to increase the number of service provider licenses during the 2020-2021 school year.

8.d.5. Amend Professional Services Agreement-Bio-Acoustical Corporation
Recommended Motion:
Board approval is requested to amend the professional services agreement between Bio-Acoustical Corporation and Alvord Unified School District.  
Rationale:

At the July 16, 2020 board meeting, an agreement (Item 7.d.6.) was approved for Bio-Acoustical Corporation to provide hearing and vision screening services for Alvord students. Due to the uncertainty of Covid-19, Bio-Acoustical has agreed to waive the cancellation fee of 10% of the total revenues on their existing contracts in the event that students are unable to be tested this school year.

Recommended Motion:
Board approval is requested for the renewal of the maintenance agreement between Konica Minolta and Alvord Unified School District, for maintenance and service of two multi-function copiers at Loma Vista Middle School.  This agreement would be effective July 1, 2020 through June 30, 2021. 
Rationale:

Konica Minolta has been a valued business partner with Alvord Unified School District for over twenty years and the District has been pleased with the services they have provided.

Board approval of this agreement will allow Konica Minolta to continue providing excellent service and maintenance to the equipment at Loma Vista Middle School. The vendor will provide labor, toner and replacement parts for the following machines.

Recommended Motion:

Board approval is requested for the renewal of the maintenance agreement between Konica Minolta and Alvord Unified School District, for maintenance and service of the multi-function copier at Norte Vista High School's Agriculture Department effective July 1, 2020 through June 30, 2021. 

Rationale:

Konica Minolta provides maintenance copier service, usage, supplies (toner and staples) and replacement parts. Konica Minolta has been a valued business partner with Alvord Unified School District for over 15 years.  They are in the industry for imaging equipment and the district has been pleased with the service they have provided. 

Board approval of this item will allow Konica Minolta to continue providing maintenance to the equipment located at Norte Vista High School's Agriculture Department.

8.d.8. Approve Master Contract and Service Order for Speech Assessments– PresenceLearning, Inc.
Recommended Motion:
Board approval is requested for a Master Contract and Service Order for Speech Assessments between PresenceLearning, Inc. and Alvord Unified School District.  This agreement will be effective from September 10, 2020 through December 31, 2020.
Rationale:
The Special Education Speech/Language Pathologist Team determined there was a need for assistance in completing the assessments that were postponed due to the COVID-19 School Closure and the State/County mandated ban in-person instruction and assessment.

The Speech/Language Pathologists have over 100 initial and triennial assessments that were postponed between March 13, 2020 and August 2020.  They also have current assessments and services to be provided with the start of school.

PresenceLearning has been providing teletherapy through contracted service providers for several years.  They are able to provide a team of licensed Speech/Language Pathologists that can complete the postponed assessments and reports; keeping Alvord in compliance with current directives from the California Department of Education.

Board approval of this item will allow PresenceLearning, Inc. to provide speech assessments, reports and IEP attendance between September 10, 2020 and December 31, 2020.

8.d.9. Approve Professional Services Agreement – Community Now, Alvord Unified School District
Recommended Motion:

Board approval is requested for a professional services agreement between Community Now and Alvord Unified School District for a teacher training. This training, “It’s my Destiny, I Choose!” by Shor Denny, CEO, of Community Now, would take place during the 2020-2021 school year. 

Rationale:
Community Now is focused on developing education and workshops in Southern California that build cultural pride and self-awareness.  

The goal of the “It’s my Destiny, I Choose!” workshop is to develop and implement mental wellness programming that will help reduce negative feelings. Participants will begin to apply a trauma-informed approach that is based on empathy and understanding of other cultures and their respected viewpoint. At the end, participants will emerge with a new perspective on the human condition; that we have more in common than the differences that have been manufactured.

Board approval of this agreement would allow Alvord Unified School District staff to participate in the Community Now “It’s My Destiny, I Choose!” 3 hour training during the 2020-2021 school year.

8.d.10. Approval Professional Services Agreement – Community Now, Alvord Unified School District
Recommended Motion:
Board approval is requested for a professional services agreement between Community Now and Alvord Unified School District for a 5-hour virtual program for high school students.  This program by Shor Denny, CEO, of Community Now, would take place during the 2020-2021 school year.
Rationale:
Community Now is focused on developing education and workshops in Southern California that build cultural pride and self-awareness. 

The goal of the program is to provide students with the general knowledge of African American culture, Trauma-Informed care, adverse childhood experiences and how this information can be applied to all aspects of personal and academic lives. 

Board approval of this agreement would allow high school students to participate in the Community Now 5-hour virtual program during the 2020-2021 school year.

8.d.11. Approve Professional Services Agreement-ECS Imaging, Inc.
Recommended Motion:
Board approval is requested for a professional services agreement between ECS imaging, Inc. and Alvord Unified School District to provide servicing and technical support for the Laserfiche Document Management System that is used to scan and store records in the Student Services and Payroll departments. 
Rationale:

Laserfiche is the software used by the district to store all student records prior to the implementation of Aeries in 2002. This software is also used by the payroll department for archived records from their department.  The professional services agreement will provide one year of support on all Laserfiche components including software updates. ECS Imaging, Inc. will provide up to ten hours of on-site/online support as well as training  and configuration services during the 2020-2021 school year.  Contract cost to be divided between Student Services and Payroll Departments.

8.d.12. Approve Riverside County Superintendent of Schools Agreement IN60179 – CTE Instructor Extra-Duty Hours, Alternative Programs and CTE
Recommended Motion:
Approve agreement between Riverside County Superintendent of Schools and Alvord Unified School District for CTE instructor extra-duty hours during the 2020-2021 school year. 
Rationale:

This agreement would allow Mark Ferguson to attend Career Technical Education meetings and events after his contract day.  The maximum hours worked under the agreement are not to exceed 50 hours during the 2020-2021 school year.

The Alternative Programs and CTE  office meets monthly with CTE teachers after their contract day.  CTE teachers attend College and Career Fairs, conferences, and prep for the CTE showcase before and after their contract day.  ROP teachers cannot be paid off of a personnel action form and must have a contract for their additional hours.  Meetings, professional development, and collaboration time is required by the grant.

This agreement was received from Riverside County Superintendent of Schools on July 28, 2020

Recommended Motion:

Rationale:

This agreement would allow Amber Kraus to attend Career Technical Education meetings and events after her contract day.  The maximum hours worked under the agreement are not to exceed 50 hours during the 2020-2021 school year.

Board approval is requested for an agreement between Achieve 3000 and Alvord Unified School District to provide reading intervention licenses for students at Foothill Elementary.  The effective date of this agreement is September 11, 2020 through June 30, 2021.
Rationale:
Achieve 3000 shall provide software license to support student intervention aimed at increasing student literacy proficiency.  The program will deliver access to non-fiction, engaging text that is aligned to grade level English language arts, science, and history-social science standards.  Additionally, teachers will receive access to online resources that will enable them to integrate the non-fiction text into their instructional planning.  

Under this agreement, Achieve 3000 shall provide student site licenses with unlimited licenses to Smarty Ants – a program that engages Kindergarten to 2nd grade students with fun, multisensory and adaptive foundational literacy instruction.  

Board approval of this agreement will make it possible for Achieve 3000 to continue to provide software licenses during the 2020-2021 school year.

Rationale:

As an established refrigeration company, Advance Refrigeration & Ice Systems, Inc. incorporates the vitality and confidence of an experienced business with the years of knowledge and expertise that comes from a qualified staff of service personnel.  

Hillcrest High School Athletic Department ice machines provide ice to care for student athletes in preventative treatment and for minor injuries. Under this agreement, Advance Refrigeration & Ice Systems, Inc. would assess the repairs necessary and provide maintenance and repairs for campus ice machines during the 2020-2021 school year.

Burtronics Business Systems has proven to be a reliable vendor. 

Board approval will allow the Norte Vista High School to continue to utilize warranty services from Burtronics Business Systems to include priority response, service calls, travel time, mileage, on-site labor, parts, masters ink, and preventative maintenance.

Board approval is requested for a Memorandum of Understanding between Alvord Unified School District and California Association for Bilingual Education (CABE) for Family Engagement Workshops. The effective date of this agreement is September 11, 2020 through June 30, 2021.
Rationale:
Years of research demonstrate that when schools form partnerships with parents, students stay in school, like school more, enroll in more rigorous coursework, and enter college or university at higher rates. CABE's Project2Inspire facilitates parent empowerment workshops to build parent capacity to authentically engage with their child's school. Project2Inspire develops the leadership skills of parents, helps parents guide the academic success of their children, and supports parents in their support of students' academic, social emotional, and personal success.

Project2Inspire will provide two Mastery Level courses, 12 three-hour sessions, with 25 parent participants per course, with in-depth knowledge of the California educational system and how it affects students and families. These participants will be recruited throughout the district as parent leaders, who will then impact change in their school sites. In addition, Project2Inspire will provide six Awareness Level courses, of 12 ninety-minute sessions, with 25 participants per course, with introductory knowledge of the California educational system and how it affects students and families. Through both of these efforts, parents will have robust conversations and be given action steps to raise the academic achievement of their students and reduce the educational gap of our most at-promise students.

Board approval of this item will allow CABE to provide virtual Family Engagement Workshops during the 2020-2021 school year.

Rationale:
Chavez Educational Services was founded in an effort to provide guidance and support to the minority communities and focuses on empowering students to achieve lifetime success through education, cultural awareness, and self-development. 

The goal of the “Step Up” workshops is to encourage students to promote leadership, cultural awareness, self-accountability, and academic success. The program aims to reduce violence, promote social awareness and increase academic achievement. 

Chavez Educational services is currently funded through the Juvenile Justice Crime Prevention Act to provide STEP UP services to Riverside County youth so there will be no charge to Alvord Unified School District.

Board approval of this memorandum of understanding would allow Alvord Unified School District students to participate in the Chavez Educational Services “Step Up” workshops during the 2020-2021 school year.

Project K.I.N.D. is a community based collaborative group built around the coalition of professional health care providers.  For the past thirteen years, Health Services has been able to provide referrals for health care, eye glasses, vision, and dental services for low income students in Alvord Unified School District.

Board approval will allow the District to continue to coordinate with Project K.I.N.D to provide medical, dental, vision, and prescription services for low income students of Alvord Unified School District during the 2020-2021 school year.

Board approval is requested for a Variable Term Waiver to be issued to one Speech, Language Pathologist to allow the district to fill an immediate staffing need by hiring individuals who are close to completing the program.   
Rationale:

The Variable Term Waiver (VTM) is a document issued for employers who meet the waiver criteria when a fully credentialed employee is not available for the assignment.  It allows the employer to fill the assignment while searching for a fully credentialed person in the subject area of the assignment and gives the waiver holder additional time to complete the requirements. 

Speech Language Pathology is considered a shortage area by the California Commission on Teacher Credentialing, in which there are no emergency permits for this area but allows for a waiver request.

Rationale:

California Education Code Section 42600 requires approval of adjustments resulting from the reconciliation of the estimated ending fund balances to the unaudited actual ending fund balances. At the time of the 2020-2021 budget adoption, the district’s estimated balance for all funds was $45,458,005.00. After completing the year-end closing process, the district’s unaudited ending fund balances for these funds is determined to be $51,407,357.86 for a difference of $5,949,352.86 for all district funds.

The difference between the estimated and actual ending fund balances must be reflected in the 2020-2021 Revised Budget, either added to the ending fund balance or allocated to a revenue or expenditure series object code. This requirement will be accomplished through the approval of Resolution No. 18.

Adopt Resolution No. 19 GANN Appropriations Limit which revises the 2019-2020 Appropriations Limit and establishes the estimated 2020-2021 appropriations limit pursuant to Article XIII-B of the California Constitution.
Rationale:

A significant event in the history of California school finance was the 1979 enactment of Proposition 4, an initiative authored by Paul Gann. This initiative established constitutional limits on the allowable growth in state and local government spending. Although many of the constraints of the Gann initiative were nullified by the passage of Proposition 98 in 1988, and the inflation factors modified by the passage of Proposition 111 in 1990, “Gann limits” still restrict government spending to a rate of no more than the State’s overall economic growth. This limit is calculated using factors such as population growth and inflation based on California’s personal income per capita.

All calculations and documentation have been prepared using applicable constitutional and statutory law. The 2019-20 district appropriations do not exceed the limitations imposed by Proposition 4. The final adjusted appropriations subject to the Gann Limit for 2019-2020 is $116,075,890.70. The estimated appropriations limit for 2020-2021 is $119,201,466.21.

Rationale:
Alvord Unified School district is committed to serving, inspiring, and promoting student and public school success by providing quality support to schools, students and community by expanding, strengthening, and leveraging partnerships with community-based organizations, funders, agencies, and other partners. 

Alvord Unified School District will partner with the Registrar of Voters to participate in a registration drive to pre-register and register students to vote. Eligible 16 and 17 year olds can now pre-register to vote online or by paper.  California youth who pre-register to vote will have their registration become active once they turn 18 years old. There are approximately 5000 students between the ages of 15 - 17 years old.

The Alvord Unified School District (District) desires to become a member of the Education Technology Joint Powers Authority (EdTech JPA) for the September 10, 2020 through September 10, 2021. EdTech JPA acts as a procurement vehicle for technology goods and allows EdTech JPA Members to leverage contracts established through the Request for Proposal (RFP) process, thus alleviating Members’ administrative costs and overhead.  Each EdTech JPA contract leveraged by the District must be Board approved and executed prior to any obligation to the District.

Board approval is requested for adoption of Resolution No. 22 – Declaration of Need for Fully Qualified Educators as required in California Code of Regulations, Title 5 and AB471 (Scott).  Adoption is required prior to the issuance of emergency permits and/or limited assignment permits for the 2020-2021 school year.  
Rationale:
Occasionally, it is necessary to assign teachers to instruct in subjects that are not authorized by their credential.  The California Commission on Teacher Credentialing understands these needs and provides alternatives to districts that will allow these assignments.

The California Code of Regulations, Title 5, requires that the Board of Education adopt a Declaration of Need for Fully Qualified Educators prior to the issuance of Limited Assignment Permits and/or Emergency CLAD documents for the 2020-2021 school year.  The Declaration must include the recruitment efforts the District has made to employ fully credentialed teachers, and an estimate of the number of teachers that will be employed under the authorization of an Emergency Permit and/or Limited Assignment Permit.  This resolution is submitted for action in order to meet these legal requirements. 

The District makes every effort to employ fully credentialed teachers whenever possible.  This resolution meets the legal requirements that will allow the District to apply for Emergency Cross Cultural Language and Academic Development (CLAD) documents.  Emergency Resource Specialist Permits, Emergency Teacher Librarian Services Permits and Limited Assignment Permits as needed.  Upon approval by the Board, the District will apply for the above referenced documents only when there is no other option.
