This updated agreement will supersede the original Letter of Agreement Board approved on June 13, 2019. As a condition for accepting a million dollar grant from the Napa Valley Vintners, a 501(c)(3) organization, the Napa Valley Unified District agreed to certain specified conditions in the Letter of Agreement with the Napa Valley Education Foundation (designated by the parties as the “lead agency”) and a Memorandum of Understanding with On The Move. This version of the same Letter of Agreement updates the prior version of the agreement with a statement of intention to renew the MOU “for up to 20 years or for the duration of the building, provided the availability of outside funding from a third party.” The Agreement the Board already approved details that NVEF will receive funding and disburse it in three equal payments over the next three years, to help defray the capital cost to the District for constructing a new facility at Napa Junction Elementary School. The building will be named through a collaborative process that incorporates the Vintners, and as appropriate, the Vintners will be named on program materials as sponsors. Once the facility is constructed and operational, currently projected for the beginning of the August 2021-2022 school year, one of the rooms will be designated a “Family Resource Center.”

The Chair and Vice-Chair of the Committee will present the recommendations and findings in the 7-11 District Advisory Committee Report on Recommendations Regarding Small School Closures and Consolidations to the Board, and the Board may discuss and ask questions of the presenters. This item is intended to inform board action items regarding potential school closures and consolidations that will be included on the October 24, 2019, board agenda. No action will be taken at the October 15, 2019, board meeting. The presentation of the 7-11 committee advisory report is for information and discussion only.

On August 8, 2019, pursuant to Education Code sections 17387, et seq., the Board of Trustees of the Napa Valley Unified School District convened a “7-11” District Advisory Committee consisting of 11 members and 4 alternates to advise the Board on potential school closures and/or consolidations and on the use of real property no longer needed for school purposes. The Committee met on August 20, September 3, September 17, and October 1, and allowed for public comment and input at each meeting. During these meetings, District staff presented information regarding the District’s budget, financial status, historical enrollment analysis, projected enrollment trends, facilities capacity, and other policy considerations. On September 17, 2019, the Committee voted to recommend closure of Yountville Elementary School and Mt. George Elementary School, and on October 1, 2019, the Committee voted to consolidate Yountville Elementary School with Willow Elementary School and Mt. George Elementary School with Alta Heights Elementary School. Also on October 1, 2019, the Committee approved the Report on Recommendations Regarding Small School Closures and Consolidations. The Report does not include any recommendations related to use of real property, as the Committee will reconvene at a later time to discuss that issue and make recommendations that will be subsequently be presented to the Board. The Chair and Vice-Chair of the Committee will present the recommendations and findings in the Report to the Board, and the Board may discuss and ask questions of the presenters. No action will be taken. |

NVUSD 7-11 Committee Report on School Closures
|

In alignment with goals #3 and #4 of our strategic plan focused on both improved safety and emergency operations and effective asset management, NVUSD would like to have a safety and security assessment completed and have an expert that can lead and complete some of the work. This hourly contract gives NVUSD the flexibility to both have a security assessment completed and have the necessary work implemented. The contractor will lead the following projects and tasks in collaboration with district staff: conduct safety and security assessments and make recommendations to address deficiencies, review all safety and security plans currently in place and make necessary modification and/or additions, review all safety and security policies and procedures and make necessary modifications and/or additions, review NVUSD’s Emergency Operation Center to ensure seamless interfacing capabilities exist with City and County operation centers, review NVUSD’s Communication Program and make necessary recommendations to ensure continuity of operations are maintained during emergencies, and collaborate with existing NVUSD technology department to ensure best practices are followed when involving safety, such as optimal security camera placement. Lastly, this work will advance the implementation of the safety and security measures articulated within the Measure H implementation plan. |

This agreement with Napa County Office of Education covers five no-cost programs and services to NVUSD. The provided programs and services to NVUSD are as follows: Attachment A: Data Use Agreement for a variety of programs and grant evaluation and application support. Attachment B: Provide assistance and support through the countywide Foster Youth Services Grant and the Homeless Assistance Act for Children and Youth. NCOE personnel to work with NVUSD personnel to provide support, assistance, and access to NVUSD foster and homeless students. Attachment C: Provide gang awareness and prevention, tobacco use prevention, and to decrease substance use through Mariposa and Bridging Brothers programs at NVUSD middle and high schools. These programs utilize Tier 2 Positive Behavior Interventions and Supports and evidence-based curricula. Attachment D: Provide Safe Routes to School safety audits and programming to NVUSD schools. Attachment E: Provide school-based tobacco-use prevention, intervention, and cessation education for all NVUSD students in grades 7 through 12. The program also provides education for 5th grade youth through assemblies, art activities, and youth development. NCOE will also deliver a minimum of four tobacco prevention workshops (with focus on vaping) to parents at middle and high schools upon request. |

10,000 Degrees (10KD) is a non-profit organization with a mission to assist low-income students get into and through college. 10KD will provide strength expert support to a cohort of approximately 100 targeted community college bound NVUSD seniors through to their matriculation to a community college. 10KD will utilize Fellows - recent first generation college graduates from low-income families- for program implementation. The fellows will communicate and collaborate with all relevant high school staff, Napa Valley College staff, and community partners. Metrics have been identified to assess success outcomes on a monthly basis. 10KD staff will provide end of semester check-ins with counselors and administration to discuss program related updates, learnings, and progress.

The bulk of JL Modular Change Order #2 for the Modular Buildings at Snow Elementary School include a change from Vinyl Composition Tile (VCT) to carpet tiles to reduce maintenance costs and improve acoustics and ease of replacement. These changes were made during the design process and implemented on the drawings prior to Department of the State Architect (DSA) approval. Additionally, there are minor changes associated with the changing of faucets in student restrooms to a more durable style, the installation of structural support for a sensory swing and additional shelving for the Kinder classrooms. Also in this change order are the design costs associated with making changes required by the California Department of Education (CDE) for compliance, which made NVUSD eligible for hardship reimbursement from the State. |

The bulk of Change Order #2 for JL Modular, Inc. on the River Middle School project are the result of pre-construction design changes made by NVUSD prior to construction and design changes required by Division of the State Architect (DSA). These changes include interconnected footings required by DSA due to the soils conditions noted in the Geo-Tech report, hot water being added to culinary sinks, floor drains added to each restroom, the removal of a dishwasher from the project scope and the implementation of the Pelican heating, ventilation, and air conditioning (HVAC) control system to the project.
Additionally, there are unforeseen conditions included in this change that encompass the winterization of footings so that work could continue during the rains, removal of abandoned transite (asbestos) underground piping and an increase in the crane size required due to unsuitable soils encountered and the standard crane unable to reach the buildings to set the roof panels. In addition to the aforementioned, NVUSD made some changes during the project that include changing from soldered copper piping joints in lieu of crimped fittings, change from Vinyl Composition Tile (VCT) flooring to epoxy for increased durability and ease of maintenance in restrooms and the installation of a Knox Box for local fire department access.
While this Change Order brings the percentage of total change for the JL Modular, Inc. portion of the project to 12.8%. This is due to one single large cost included in Change Order #1. Change Order #1 included the total costs of $287,000 to over-excavate and rebuild the building pads in preparation for the modular buildings. This change was required due to unsuitable soils encountered in these building pad locations, which could not have been foreseen. While this condition resulted in significant costs. Shifting this scope to JL Modular, Inc. resulted in an approximate $125,000 savings from the total cost for the work. Overall the project is still working within the allocations set forth in the implementation plan for this project and contingency. |

Change Order #2 $210,286.25 (3.5% of the original contract). The total cumulative change orders for the Design-Build Modular Buildings at River School Project are in the amount of $777,574.54, 12.8% of the original contract, which are within the allocated amount of contingency budgeted.

This Change Order includes several differing Change Order Conditions. These changes include the replacement of aged sewer lines that were originally scheduled to be reused, removal of an unforeseen gas main and installation of domestic water at the trash enclosure as required by the Health Department. Additionally, there are changes associated with items not clearly indicated on the Contract Drawings and therefore, not included in the Contractor’s scope of work. These items include: added seismic to Building B lighting, addition of door louvers at restroom doors, fire sprinklers at freezer and cooler locations and power for the motorized bleachers. As has been the case with this particular site, there are changes associated with unsuitable native soils that are being encountered. The soils at this site will frequently not meet compaction requirements. Therefore, there are changes associated with mitigation of unsuitable soils, off-site improvements required by the city and reconfiguration of subgrade under site concrete to minimize soil impacts to the site concrete process. Finally, there are District driven changes, such as additional plumbing cleanouts in the Gymnasium to facilitate ease of maintenance; a change from Vinyl Composition Tile (VCT) flooring to carpet tiles to reduce maintenance costs, improve acoustics and ease of replacement; a credit for Douglas-fir base as the project has changed to standard rubber base; and City water connection fees. |

Change Order #6 $195,368 (1% of the original contract). The total cumulative change orders for the Modernization and New Construction at River School Project are in the amount of $1,167,607, 6.1% of the original contract, which are within the allocated amount of contingency budgeted.
