Rationale:

State Government Code Section 66001 & 66006 requires public agencies, which levy development fees, to submit to the governing board an annual report.  Attached is the annual analysis, for fiscal year 2018-19, of the developer fee account (Fund 25) for the District.

H.2.b. Amendment to Consulting Services Contract with Disario and Associates (Consent Item)
Rationale:

The Board approved a 2019-20 Consultant Services Contract with Disario and Associates at the June 20, 2019 board meeting.  Disario and Associates provide consulting to the Superintendent and Executive Cabinet in the areas of school business, facilities and other consulting as directed by the Superintendent.  The original contract was in the amount of $100,000.  It is requested that the Disario contract be increased by $75,000.

Rationale:

The 2020-2021 Student Calendar has three additional days added to this school year allowing for possible PSPS/fires school closures.  

If there are no school closures due to PG&E PSPS shut offs or fires, then additional days will become breaks during the second semester.

By January 11, 2021, the district will confirm and communicate the status of these days with staff and families.

 A committee of mixed stakeholders including teachers, staff and parents, will convene at the beginning of next school year to redesign the calendar for 2021-22 and beyond.

H.4.a. Extension to Contract for Services with ProCare Therapy (Consent Item)

Rationale:

This is an extension to the already approved assignment for a Certified Occupational Therapy Assistant through a contract with ProCare Therapy.  The assignment was approved at the October 24, 2019 Board meeting for October 14, 2019 through December 31, 2019.  

The extension is for January 13, 2020 through January 31, 2020 and is needed to meet the needs of students as identified through their Individual Education Plans at sites where the district Occupational Therapist is on medical leave and whose medical leave has been extended.

ProCare Therapy is a Non-Public Agency supporting schools in staffing both healthcare and school professional positions for special education and health care needs.

The Master Contracts for all Non-Public Agencies are approved through the Napa County Special Education Local Plan Area (SELPA) prior to being released for Districts.  The SELPA works as part of the Bay Area Consortium to establish rates for Non-Public Agencies and establish terms within the Master Contracts.  Districts are then able to set Individual Service Agreements with Non-Public Agencies to meet their needs.

Fiscal Impact: $7,192.50.  Funding Source: Special Education.

Rationale:

Cornerstone Earth Group requires an amendment of additional services to complete the Preliminary Endangerment Assessment (PEA) Workplan for the River Project.  This work is necessary in order to apply for State Facilities Funding through the Office of Public School Construction for construction of new classroom buildings on the River Campus.

H.5.b. SPC 26.113-17 Amendment for Inspector of Record Services at River School (Consent Item)
Rationale:

C.R. Flores, Inc requires amendment to the existing contract for Inspector of Record (IOR) services.  The amendment is specifically associated with the River Middle School Measure H Project.  IOR services will be extended to cover the completion of the project and associated close-out activities between January 2020 through June 2020. 

It is required by the State of California, Department of General Services, Division of the State Architect (DSA) that this project have continuous inspection.  The IOR is certified by DSA to inspect projects on behalf of DSA, for compliance with the plans and specifications previously approved by DSA.  The IOR also coordinates with the other specialty inspection services needed for items such as soils, structural reinforcement or concrete.  The IOR's duration of services is based upon the duration of the project.  At the time the IOR submits a proposal, the general contractor has not yet submitted their schedule and therefore the IOR's duration and fee has the potential to change.

Rationale:

The Notice of Completion (NOC) is filed by the District upon completion of the project.  By filing the NOC with the County of Napa, the District puts all involved parties on notice that the project has been completed.  This document mitigates the owner's risk against liens being filed against their property as it reduces the time frame within which contractors must act upon any payment grievances.

J.1.b. Request for Allowance of Attendance Because of Emergency Conditions J-13A Waiver (Action Item)
Rationale:

October 9, 10, 28, 2019 all schools within the Napa Valley Unified School District were closed due to power shutdowns by Pacific Gas and Electric Company due to high winds and potential fire hazard.  On October 29, 2019 specific sites remained closed: American Canyon High School, American Canyon Middle School, Canyon Oaks, Donaldson Way, Napa Junction, Browns Valley, West Park and Yountville.  California Department of Education (CDE) requires a waiver be submitted to obtain approval of attendance and instructional time under Education Code Section 41422. 

 
Financial Impact:

The District could lose approximately $3,786,161 in ADA due to the school closures.

Rationale:

At the annual organizational meeting, December 12, 2019, discussion was held in regards to an increase to the monthly stipend for governing board members. Pursuant to Education Code Section 35120, for a district the size of the Napa Valley Unified School District, Governing Board members who attend all board meetings (unless excused) are entitled to compensation in a sum not to exceed $400 per month.  The Governing Board may increase this monthly stipend on an annual basis in an amount not to exceed 5%. An increase of 5% would adjust the monthly stipend for governing board members to $420 per month. Increase to be effective January 1, 2020.

 
Financial Impact:

Funding Source: General Fund.   Financial Impact: $1,680 annually.

J.1.d. NVUSD Board Room upgrade Phase II (Action Item)
Rationale:

NVUSD records all board meetings online.  The audio and video hardware and software are in need of repair and upgrade.  The purpose of this request is to repair and upgrade the hardware and software used for the NVUSD board room.  The scope of work is planning to include the following: Update cabling to HDMI standards for all media connections, update control panels, purchase and installation of 3 cameras for speaker coverage, purchase and installation of A/V management system(software/hardware), installation of 2 flat screens providing improved visibility for attendees, provide an efficient board room experience for our staff and community.  Completion of this second phase of work will also allow for better visibility for attendees and a streamlined process for board room operation.

 
Financial Impact:

Funding Source: Measure H.  Fiscal Impact: $105,998.31.  ASG(Cameras, TV’s, and A/V Equipment) - $79,223.31 (Bid threshold for equipment as of 1/1/2020 is $95,200).  Melzak Media(installation and professional services) - $26,775.00 (Bid threshold through CUPCCAA is $60K).

Rationale:

Facilities, Maintenance and Operation (FMO) staff is requesting approval of the Notice of Completion for FMO MDM 06.01.19 Painting Shearer and McPherson sites.  The Major Deferred Maintenance project has been successfully completed and the Business Services Office is requesting signature on the Notice of Completion attached to close the MDM contract as complete for the following contractor:  FMO MDM 06.01.19 Painting Alpha G Painting.
